A Supreme Court in Georgia has ordered that sexual assault charges on
former Model High School basketball coach Daniel Lowell Brown be dropped on
Monday. Brown was accused of having sexual contact
with a student in November of 2008.
It was ruled that Brown was involved in a consensual teacher-student relationship.
A ruling in Chase v State in June 2009 stated that a lower court make a mistake in the trial of a teacher who was also charged in having sex with a student by not considering if the relationship was consensual.
Floyd County District Attorney Lea Patterson said that the Chase case has lead many District Attorney`s to drop charges that would not normally have been.
Patterson added that state representatives are planning to present a bill at the next legislative secession to clarify the statute.
