Spouse Can Get Medical Info of Dead Loved One

The Georgia Supreme Court ruled 6-1 on Monday that a surviving
spouse may obtain protected health information of a deceased partner
when no executor or administrator has been appointed to their estate.
The court ruled in favor of Mary Miller who requested copies of her
deceased husband`s medical records from the nursing home facility
where he lived before he died.
The court said that Miller is allowed to get most medical records,
besides certain health records and privileged or confidential
communications.
